There appears to have been some ambiguity over whether the Anne family, in addition to owning the manor of Burghwallis, were also the owners of the advowson, that is, the right of presenting a clergyman to the living of the parish church. This difficulty was compounded by the fact that, from the early seventeenth century, there were legal restrictions upon Roman Catholics (which the Anne family were) in presenting a living of the Church of England. Several cases for the opinion of counsel are devoted to the explication of these problems.
