Scope and Content

Whereas by Indenture dated 24 July 1761 [Doc 427] Thomas Eaton of Bulmer, Essex, and Mary his wife mortgaged to John Willet of Cambridge certain lands in the above parishes, and agreed to levy a fine of the lands to Thomas Cheetham of Cambridge and his heirs to be to the use of John Willet for the term of the mortgage, and on determination to the use of Thomas Eaton and George Sully of Cambridge and their heirs to the use of Thomas Eaton and George Sully and the heirs of Thomas Eaton for ever; and whereas the sum lent was not paid and the estate of John Willet has become absolute; and whereas the principal sum only is owing to John Willet; and whereas John Willet has applied for his money and Thomas Eaton has applied to William Cole of Ely, Cambridgeshire, for the loan of the sum required; John Willet at the request of Thomas Eaton assigns, and Thomas Eaton confirms the lands to William Cole for the remainder of the term of one thousand years, together with certain lands held of the Manor of Swaffham Prior and surrendered conditionally, in trust for John Bringhurst a minor; if Thomas Eaton pays a certain sum by a certain date William Cole is to reconvey the lands. Witnesses: (for William Cole) Rebecca Kempton, John Gotobed; (for John Willet and Thomas Eaton) Elizabeth Brown, Charles Martindale. On the back is a receipt for the consideration money signed by John Willet. Witnesses: the same. Part of three seals are attached.

Acquisition Information

Purchased from John Whitaker, Cambridge (from Hove, Sussex) 13 August 1917 (With this cf Add 5958(14), the original of which was bought from E. Williams, 37 New Town, Hove, Sussex. Mr Whitaker's lot from Hove presumably came from the same vendor.
