Scope and Content

Thomas Tomson of Cambridge sells to Charles Southwell of New Zealand, Barnwell, certain premises in New Zealand for the term of one year at a peppercorn rent, that Charles Southwell may be able to take a release. Witnesses: George T. Whiteley, Joseph Wentworth. Whereas by indentures dated 12 and 13 November 1810 certain land in Barnwell stands limited to such uses and trusts as Thomas Tomson of Cambridge shall appoint; and whereas Charles Southwell of New Zealand, Barnwell has agreed with Thomas Tomson for the purchase of the land; Thomas Tomson appoints that the land in question shall be to the uses and purposes herein expressed; and Thomas Tomson releases to Charles Southwell the land in question to the use of such persons as Charles Southwell shall appoint, and in default of such appointment to the use of Charles Southwell for life, to the use of Thomas Chisholm of Cambridge during the life of Charles Southwell, afterwards to the use of Charles Southwell and his heirs for ever. Witnesses: the same. Receipt for the sum mentioned signed by Thomas Tomson. Witnesses: the same. Both copies are certified by Frederick Randall and Nathaniel Lyon, 9 July 1829.
