Whereas by Act of Parliament for enclosing lands in the above parish it was enacted that Joseph Truslove of Cambridge and William Custance of the same should be appointed Commissioners, and they were required to allot certain lands in compensation to the proprietors of tithes, and that if Thomas Panton prefer to sell the lands to be allotted to him the Commissioners might sell such land by auction, a certain sum being deposited with them at the time of the auction, and if the sum were not afterwards paid the Commissioners might sell the lands; and whereas Thomas Panton was desirous of selling his share of the land, and the Commissioners allotted it and gave notice of sale for November 1808; and whereas Thomas Tomson of Cambridge of Cambridge was the highest bidder for certain lots and deposited a certain sum in respect of them with the Commissioners; and whereas Thomas Panton died before the conveyance could be effected; and whereas under the will of Robert Duke of Ancaster and Kesteven, dated 29 May 1779, and by Indenture dated 17 June 1809, and by Common Recovery suffered in 1809 all the lands of the late Thomas Panton in the above parish are settled to the use of such person and upon such trusts as Peter Lord Gwydir, Priscilla Barbara Elizabeth, Baroness Willoughby of Eresby, his wife and the Honourable Peter Robert Drummond Burrell, their eldest son, shall appoint; and whereas Peter Lord Gwydir, Priscilla Barbara Elizabeth Baroness Willoughby of Eresby and Peter Robert Drummond Burrell have requested the Commissioners to proceed with the sale and agreed to join in the conveyances; now in consideration of the remainder of the purchase money Peter Lord Gwydir, Priscilla Barbara Elizabeth Baroness Willoughby of Eresby and Peter Robert Drummond Burrell have appointed the lands to the uses hereinafter mentioned; and Joseph Truslove, William Custance, Peter Lord Gwydir, Priscilla Barbara Elizabeth Baroness Willoughby of Eresby and Peter Robert Drummond Burrell release to Thomas Tomson the above-mentioned land upon trust as Thomas Tomson shall appoint and in default of appointment to Henry Balls of Cambridge during the life of Thomas Tomson to prevent Thomas Tomson's wife being dowable(?) out of the land, and after the death of Thomas Tomson to his heirs and assigns for ever. Peter Lord Gwydir, Priscilla Barbara Elizabeth Baroness Willoughby of Eresby and Peter Robert Drummond Burrell undertake to produce the title deeds when required.There follows a Schedule of deeds of conveyance of the land 1723-1810. Witnesses: for Peter Robert Drummond Burrell: James Adam; for Thomas Tomson: John Hitch of Cambridge, Thomas Potter; for Joseph Truslove and William Custance: Thomas Fiske, Thomas Sewell; for Peter Lord Gwydir and Priscilla Barbara Elizabeth Willoughby of Eresby: Edward Bray, Augustus Warren, B. Wadham; for Henry Balls: John Hitch of Cambridge , Henry Balls junior. A receipt for the purchase money follows signed by Joseph Truslove and William Custance. Witnesses: Thomas Fiske, Thomas Sewell. Subscribed by Andrew Storey, Thomas Pursell Hart, clerks to Mr Edwards, solicitor, Cambridge.
