Whereas by Indenture of Assignment dated 19 June 1779 a Mortgage raised by Indenture dated 24 July 1761 [Doc 427] between Thomas Eaton of Bulmer, Essex, and Mary his wife, John Willett of Cambridge, Thomas Cheetham of the same and George Sully of the same on certain land of Thomas Eaton's in Swaffham Bulbeck became secured to Sarah Fowle of Cambridge and Mary Fowle of the same in pledge for a sum lent to Thomas Eaton; and whereas Thomas Eaton 19 June 1779 made a conditional surrender to Sarah Fowle and Mary Fowle of certain land held of the Manor of Swaffham Prior; and whereas Sarah Fowle by will dated 1780 bequeathed her estate to Mary Fowle appointing her executrix; and whereas Mary Fowle by will dated 1 July 1783 appointed William Fisher of Cambridge her executor and residuary legatee; and whereas the capital sum has not been paid; and whereas William Fisher has called in the sum; and whereas Francis Mann of Lolworth, Cambridgeshire, has agreed to lend the sum to Thomas Eaton; William Fisher and Thomas Eaton assign to Francis Mann, of Lolworth, Cambridgeshire the land in question for the remainder of the term of one thousand years at a peppercorn rent, provided that if Thomas Eaton repay the sum with interest by a certain date Francis Mann is to reassign the land; Thomas Eaton agrees to surrender his copyhold lands to the use of Francis Mann with the same proviso for redemption; Thomas Eaton declares that the remainder of a term of one thousand years raised by a Mortgage of 26 March 1756 to the Reverend James Salt shall be a further security to Francis Mann. Witnesses: James Crow, Thomas Bullen. On the back is a receipt for the consideration money signed by W. Fisher. Witnesses: the same. Three seals are attached.

Purchased from John Whitaker, Cambridge (from Hove, Sussex) 13 August 1917 (With this cf Add 5958(14), the original of which was bought from E. Williams, 37 New Town, Hove, Sussex. Mr Whitaker's lot from Hove presumably came from the same vendor.
