Mortgage indenture, Shefford, Bedfordshire

Whereas George Hailey of Shefford by will dated 23 May 1760 devised to his son George Hailey and his heirs for ever all his property in Shefford and Arlesey, Bedfordshire, subject to the payment of an annuity to the testator's mother, Sarah Hailey, for life, and if George Hailey should die before twenty-one, then to his son Thomas Hailey and his heirs for ever, subject to the annuity and to the payment of a certain sum apiece to the testator's three daughters, Ann, Lucy and Sarah Hailey; and whereas Sarah Hailey is dead; and whereas George Hailey died before twenty-one; and whereas the three daughters have been paid their legacy; and whereas Thomas Hailey by will dated 17 December 1808 bequeathed to his wife Mary Hailey the residue of his estates; Mary Hailey of Pirton, Hertfordshire sells to James Cook of Hitchin certain land in Shefford, conveyed by Thomas Squire and Mary his wife to the use of George Hailey and his heirs by Indentures of Lease and Release dated 21 and 22 August 1745 [Doc 238 and 239,] and by the same to the same by Indentures of Lease and Release dated 27 and 28 December 1753 [Doc 240], and allotted to Thomas Hailey by an award dated 23 October 1799 by the Commissioners for enclosing land in Campton and Shefford, Bedfordshire, for the term of a thousand years at a peppercorn rent. If Mary Hailey pays to James Cook a certain sum by a certain date, the agreement is to be void. Witness: D. Times, Attorney, Hitchin. On the back is a receipt for the consideration money signed by Mary Hailey. Witness: the same. One seal is attached.
