Discharge of mortgage, Cambridge

On 30 Dec 1765, the late Zachariah Mart of Cambridge, gent, mortgaged (in the form of a lease for 1,000 years at peppercorn rent) for #20 his tenement and yard in Walls Lane, parish of the Holy Trinity, Cambridge, late the estate of James Bangle, deceased, to John Whittred of Cambridge, butcher and alderman. By his will of 5 Oct 1766 Mart bequeathed his freehold and leasehold property to his friends Thomas Johnson, merchant, and John Smith, gent, both of Cambridge, as trustees, all such property to be sold and the money so raised to be applied to various uses specified therein. On 28 Oct 1766 Thomas Johnson bought the said tenement for #52 10s at public auction. Of this sum, #20 10s is to go to Whittred to discharge the mortgage. Johnson and Smith agree to convey the tenement to Edward York, joiner, and William Musgrave, draper and salesman, both of Cambridge, to hold in trust for Johnson and his heirs. It is agreed by all parties that the tenement and the term of 1,000 years should be assigned to William Minshaw of Cambridge, innholder, to attend and wait upon the fee simple and inheritance so agreed to be conveyed to York and Musgrave, thus barring the possibility of any mesne encumbrance. By this indenture, in consideration of #20 10s paid to him nominally by York and Musgrave, but in reality by Johnson, and of 5s paid him by Minshaw, Whittred assigns his mortgage to Minshaw, in trust as above. Four-part indenture, signed and sealed by Whittred, Johnson, Smith, York, and Musgrave, witnessed by William Lamborn, William Radford, Thomas Fletcher, and H Humphreys, duty stamps. Endorsed with receipt for consideration money, same date, signed by Whittred and witnessed by Lamborn and Radford.
